The dual system of civil partnership for same sex couples and marriage for different sex couples means married transgender people are forced to choose between ending their marriage and having their acquired gender officially recognised by law. The review finds that the current options either to end the marriage and enter into a civil partnership, or remain in a marriage but not be recognised in one’s acquired gender, means that transgender people cannot enjoy their right to a private identity and personal relationships, such as marriage.
